Re: Proposed New Access Legislation in Wales

Thanks to everyone that responded to Canoe Wales & British Canoeing's recent consultation regarding our response to the Welsh Government. We had over 1000 people feedback, with the vast majority supporting not only our suggested response, but also helping us give the Welsh Government a very clear v...

Barcombe Mills

Hi all A news item relating to paddling on the Sussex Ouse at Barcombe Mills. We have been defending paddling at this site to the Environment Agency, who had installed restrictions on bank access for paddlers after a legal challenge by some anglers. Our Local Waterway Adviser (Clive Edwards) and Reg...

Re: British Canoeing - Trespass Policy

We've had a few more reports of people being challenged on or by the river over that past few weeks. Please have a read through this advice (especially the full document), and if possible help us spread this message to more canoeists. The article is at - https://www.britishcanoeing.org.uk/news/2017/...

Re: British Canoeing - Trespass Policy

Interesting document from www.anglingtrust.net/core/core_picker/download.asp?id=2277 Canoeists, rowers and anglers can coexist happily. However, there can be disputes. Here we look at the legal and practical issues surrounding public and private rights of navigation on tidal and non-tidal waters. A...

Re: British Canoeing - Trespass Policy

Ditto the Rambliars, who kick started their campaign for the right to access the countryside with a mass trespass on Kinder Scout, [ although in truth most of those attending were from the local communist party who saw it as an opportunity to stick it to the local land owning gentry]. Exactly. The ...

Why the sudden interest in angling?
A question was posed earlier in the thread about whether anglers could cast across the half of a river they have fishing rights to, or whether that would be trespass. Legal advice to anglers appears to suggest this would be trespass.

Re: British Canoeing - Trespass Policy

Another variation! An angler stands, casts and catches a fish on his/her side of the river but the fish, in it's attempts to free itself, swims to the opposite side. Has an offence been committed and if so was it by the angler or the fish? You would hope for a judge to show common sense in that cas...

Oooh... if we are into trespass conundrums... So the left and right banks are owned by different land owners. The divide is in the middle of the two banks. So the land owner on the right bank lets people fish from his bank. The landowner on the left hates fishing and doesn't want anyone fishing "on...

Re: Post-Brexit Rural policy

Most paddlers want to see BC' state that although the law is untested, they support the view that there is a right of navigation on all rivers. Simple. Paddlers accept that access to rivers has to be over land with permission granted or via public land. Paddlers are very consistent on this - and we...

Re: Is BCU Insurance valid on private reservoirs?

I’m sure I read somewhere that CE insurance only covers inland waterways & canals with whom CE has an access agreement. The Third Party Liability Insurance that comes with British Canoeing membership covers you anytime you are out paddling - so in/on a SUP/Canoe/Kayak etc. If the policy only covere...

Re: British Canoeing - Trespass Policy

Hi Chris, It's a great document - I think "the beef" here is that calling it the "Trespass Policy" is a negative outlook and implies that to kayak you need to trespass. Perhaps a re-wording of the title - Title: Your Access Rights. Subtitle: What to do if challenged as trespassers. - would fit with...

You need to tread very carefully on the subject of the various Brighton Reports, Chris. If you read beyond the executive summaries (and you need to) you will see two completel...

Re: Access for All

We work on a figure of 4% of rivers having an uncontested Right of Navigation. This is based on research the University of Brighton did in the early 2000s, which looked at rivers over a certain width (3m from memory) which could be shared. It only includes rivers (not canals) but this includes manag...

Re: Who has rights to launch from portage in fishing season, anglers or kayak? New to sport need advice please.

What river/canal is this on - assuming from your post this is a managed waterway (CRT / Environment Agency or similar?). There are no hard and fast rules. The main place CRT like to try and discourage canoeists and anglers is at lock approaches where powered craft need access to get on/off their boa...
